Is California getting rid of smog checks?

While the short answer is no—smog checks are still a critical part of vehicle registration for most drivers—there are several interesting legislative updates and existing exemptions that every vehicle owner should know about.

Ongoing Discussions & "Leno's Law"

While the state is not getting rid of the program entirely, there are targeted efforts to refine it. For example, Senate Bill (SB) 1392, a new version of what's often called "Leno's Law," was introduced to create a limited pathway for certain collector vehicles to be exempt from biennial smog checks. This is a very specific exemption designed for historically significant or collector cars, and it phases in eligibility over time.

Who is Currently Exempt?

The California DMV already provides several exemptions based on the age and type of the vehicle:

• 1975 or Older: Gasoline-powered vehicles model year 1975 or older are exempt.
• Diesel Vehicles: Diesel-powered vehicles model year 1997 or older are exempt.
• Electric Vehicles: Fully electric vehicles do not require a smog check.
• Newer Vehicles: Gasoline-powered vehicles less than eight model years old are generally exempt from biennial testing, though owners may pay a smog abatement fee instead.

There is also broader discussion about federal impacts on California's ability to set its own emission standards. Some experts suggest that changes to federal laws like the Clean Air Act could eventually impact how California enforces its smog check program.
